TERMS AND CONDITIONS

  • By creating an account or using ARS, you agree to be bound by these Terms and Conditions. ARS is operated by HAUS ARS (ABN 47 645 592 004). If you do not agree to these terms, you may not use the platform. We reserve the right to update these terms at any time; continued use after changes constitutes acceptance.

  • You must be at least 18 years old to create an account and make or receive payments on ARS. By registering, you confirm that you meet this requirement.

  • ARS connects buyers and sellers of original artworks. All sales are final once payment is confirmed. Sellers are responsible for the accuracy of their listings, including descriptions, dimensions, and condition. HAUS ARS takes no responsibility for disputes arising from inaccurate listings. Nothing in these terms limits any rights you may have under the Australian Consumer Law.

  • Bids placed in live auctions are binding commitments. The highest bidder at the close of an auction is obligated to complete the purchase. Sellers may cancel an auction only within one hour of creation and only if no bids have been placed.

  • Payments are processed securely via Stripe. HAUS ARS charges a platform fee of 10% (inclusive of GST where applicable) on each completed transaction. This fee is deducted from the seller's proceeds. All prices are listed in Australian dollars (A$) and are inclusive of GST unless otherwise stated.

  • You agree not to: list counterfeit, stolen, or infringing artworks; manipulate auction prices through shill bidding; harass or abuse other users; attempt to circumvent platform security; or use ARS for any unlawful purpose.

  • Artists retain copyright over their works. By listing an artwork on ARS, you grant HAUS ARS a limited, non-exclusive licence to display images of the work for the purpose of operating the marketplace.

  • ARS is provided on an "as is" basis. To the maximum extent permitted by Australian law, HAUS ARS and its affiliates are not liable for any indirect, incidental, or consequential damages arising from your use of the platform.

  • These terms are governed by the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Australia.

PRIVACY POLICY

  • When you create an account on ARS, we collect your email address, display name, and any optional profile details you provide (such as location and biography). When you make a purchase or list an artwork, we collect transaction details necessary to process payments via Stripe. We do not store full payment card details on our servers.

  • We use your information to operate the marketplace, process transactions, send you notifications about your orders and bids, and personalise your experience. We may send you product updates and promotional communications — you can opt out at any time in Settings.

  • We do not sell your personal information. We share data only with trusted service providers necessary to run ARS (including Stripe for payments and Clerk for authentication), and only to the extent required to deliver those services. We may disclose information when required by law.

  • Your display name, profile photo, listed artworks, and public activity (such as artworks you have sold) are visible to other users. Your email address is never displayed publicly.

  • We retain your account information for as long as your account is active. You may request deletion of your account and associated data at any time by contacting us at hello@haus-ars.com.au. Certain data may be retained for legal or fraud-prevention purposes.

  • We use industry-standard encryption and security practices to protect your data. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

  • ARS is not directed at children under 13 years of age. We do not knowingly collect personal information from children under 13.

  • We may update this Privacy Policy from time to time. We will notify you of significant changes via the app or email. Continued use of ARS after changes constitutes acceptance of the updated policy.

  • These terms are governed by the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Australia.
